Terms of Service
1. About these Terms
These Terms of Service govern access to and use of Music Arcademy, including Chord Rush, Note Clash, future Music Arcademy games, websites, account features, subscriptions, learning tools, rankings and related services.
By creating an account, using an authenticated feature or purchasing a subscription, you agree to these Terms. If you use Music Arcademy for a minor, you confirm that you are the minor’s parent or legal guardian, that you authorize the use, and that you accept these Terms on the minor’s behalf.
Mandatory consumer rights under applicable law are not limited by these Terms.
2. Eligibility and minors
You may independently enter into a paid contract only if you are at least 18 years old and legally capable of doing so.
A user under 18 may use Music Arcademy only with parental or legal-guardian permission and supervision. The parent or guardian must make and manage any purchase for the minor and is responsible for the minor’s account and use.
Where consent is required for processing a child’s personal data, a child under 14 must have the required authorization of a parent or legal guardian.
We may request reasonable confirmation of age or parental authority when necessary for safety, legal compliance, billing or account support.
3. Accounts
You must provide accurate account information and keep access to your email and authentication method secure. You are responsible for activity performed through your account unless you promptly report unauthorized access.
You must not:
- create accounts using another person’s identity without permission;
- sell, transfer or share a paid account in a way that bypasses plan limits;
- use an offensive, unlawful, misleading or infringing Player Name;
- interfere with authentication, access controls or usage limits.
Player Names, selected country and official scores may be displayed publicly in Hall of Fame, rankings or challenge-related surfaces. Guest activity is not official competitive participation.
4. The service
Music Arcademy provides browser-based music-learning games and related progress, practice, diagnostic and competition features. Features may depend on a compatible browser and device, an internet connection, optional MIDI hardware, supported authentication methods, and the plan and entitlement assigned to the account.
We may improve, modify, add or remove features. For a paid continuous digital service, changes will not remove mandatory consumer rights. We will provide notice where required by law or where a material change significantly affects the paid service.
Music Arcademy is an educational practice tool. It does not guarantee a particular learning outcome, examination result, professional qualification or performance level.
5. Plans and access
Music Arcademy may offer Anonymous, Free and Pro access. The current Access Matrix determines which content, sessions, progress, rankings and practice systems are available to each tier.
Pro entitlement is server-authoritative. A checkout success page, browser state or local storage entry does not independently grant Pro.
Lifetime is not offered during the Founding 100 campaign.
6. Paid subscriptions
Before purchase, the checkout flow will clearly display the plan; billing frequency; total base price; applicable taxes or how they are calculated; whether the subscription renews automatically; the renewal price; cancellation terms; refund and withdrawal rights; the business identity and contact details; and links to these Terms, the Privacy Policy, the Refund & Cancellation Policy and the Support Policy.
The final purchase control uses unambiguous wording showing that the order creates an obligation to pay, such as “Subscribe and pay.”
Monthly and Annual subscriptions renew automatically until canceled.
7. Founding 100
During Founding 100:
- standard Monthly price: USD $9.99;
- standard Annual price: USD $59.00;
- Founding Monthly price: USD $4.99;
- Founding Annual price: USD $29.50;
- Monthly and Annual are the only Founding plans;
- Lifetime is unavailable;
- the Founding price is retained only while the subscription remains continuously active.
Join the first 100 players and lock in 50% off for as long as you stay subscribed.
If you cancel, any future subscription will use the price available at that time.
8. Cancellation
You may cancel through the supported billing/account flow or contact support.
Normal cancellation is scheduled for the end of the current paid period. You retain Pro until that date, and future renewal stops.
You may resume before the effective cancellation date. A timely resume preserves the continuous subscription and Founding price.
After effective cancellation, the old subscription is not reactivated. A new subscription is required, and the available price at that time applies.
9. Payment failure
A failed renewal may enter the approved seven-day grace period. During grace:
- Pro remains available;
- payment recovery may be attempted;
- the account will display a payment issue;
- successful recovery preserves the continuous subscription and Founding price.
If payment is not recovered by grace expiry, Pro ends and the subscription is canceled under the approved billing policy.
10. Refunds and withdrawal
Our commercial refund policy provides a full refund within 14 calendar days of the first Monthly or Annual payment, even if use has begun. This policy is in addition to any mandatory statutory right of withdrawal or remedy.
A refund or withdrawal request may be submitted through the online withdrawal function during the applicable withdrawal period, or by emailing support@musicarcademy.com with an unequivocal request.
Full details appear in the Refund & Cancellation Policy.
11. Acceptable use
You must not:
- break the law or infringe another person’s rights;
- access another person’s account;
- bypass access, payment, quota or security controls;
- manipulate official scores, leaderboards, challenges or evidence;
- use bots or automation to gain an unfair competitive result;
- reverse engineer the service except where applicable law expressly permits it;
- introduce malware or attempt unauthorized access;
- scrape, copy or redistribute substantial service content;
- use the service to harass, threaten or impersonate others;
- overload or disrupt the service.
We may remove invalid competitive results or restrict an account where reasonably necessary to protect users or the service.
12. Intellectual property
Music Arcademy, its software, designs, game systems, text, graphics, audio, logos and original content are owned by or licensed to U.X. DESIGN STUDIOS LIMITED and are protected by applicable intellectual-property law.
We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the service for lawful personal educational use under these Terms. No ownership rights are transferred to you.
13. User-provided information
You retain rights in information you provide, such as a Player Name, support message or feedback. You give us a limited license to host, process and display that information only as needed to operate the service, provide public ranking features, respond to support and improve the product.
Do not submit content you do not have the right to use.
Feedback may be used to improve Music Arcademy without payment or obligation, but we will not publicly attribute private feedback to you without permission.
14. Service availability and updates
We aim to provide a reliable service but do not guarantee uninterrupted availability. Maintenance, security incidents, provider failures, browser changes or events outside reasonable control may cause temporary interruption.
We will provide updates, including security updates, where required to keep a paid digital service in conformity with the contract. Nothing in these Terms excludes a consumer’s mandatory remedies where a digital service is not supplied or does not conform to the contract.
15. Suspension and termination
We may suspend or restrict access where reasonably necessary because of fraud or chargeback risk; security compromise; unlawful or abusive conduct; leaderboard manipulation; material breach of these Terms; or a legal requirement.
Where reasonable, we will explain the reason and provide an opportunity to contact support. Suspension does not remove mandatory refund, withdrawal or consumer rights.
You may stop using the service and delete your account at any time, subject to the effect on an active subscription explained during deletion.
16. Disclaimers and liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or mandatory consumer rights.
To the extent permitted by law:
- Music Arcademy is provided with reasonable care and skill but without guarantees beyond the contract and applicable law;
- we are not liable for losses caused by unsupported devices, third-party hardware, internet failure or unauthorized account use that was not caused by us;
- we are not liable for indirect or purely consequential loss that was not reasonably foreseeable when the contract was formed.
For non-consumer users, our aggregate contractual liability is limited to the amount paid to us for the affected service during the 12 months before the event giving rise to the claim. Consumer remedies under applicable digital-content and digital-service law remain unaffected.
17. Governing law and disputes
These Terms are governed by the laws of the Republic of Cyprus. If you are a consumer, this choice does not deprive you of mandatory protections available under the law of your country of residence, and mandatory consumer jurisdiction rules continue to apply.
Please contact support@musicarcademy.com first so we can try to resolve a complaint. Consumers may also have access to a competent consumer authority, court or approved alternative dispute-resolution body.
18. Changes to the Terms
We may update these Terms for legal, security, product or operational reasons. We will publish the updated date and provide reasonable notice of material changes where required. Changes do not retroactively remove accrued consumer rights.
